Terms of Use for the 45-m Radio Telescope
at the National Astronomical Observatory of Japan (NAOJ) Nobeyama



Enacted on April 1st, 2022

Article 1. Purpose
These Terms of Use set forth the use of telescope time of the 45-m radio telescope at the National Astronomical Observatory of Japan (NAOJ) Nobeyama (hereinafter referred to as the "45-m Radio Telescope").

Article 2. Purpose of Use
The use of the 45-m Radio Telescope shall be limited to astronomical use such as radio astronomical observations and hands-on radio astronomical observational tutorials.

Article 3. Application Eligibility
Only researchers, students, and the like who intend to conduct astronomical research, whether inside or outside Japan, shall be eligible to apply.

Article 4. Application Method and Telescope Allocation Period
Details of the application method and telescope allocation periods shall be provided in the application guidelines issued and communicated by the Nobeyama Radio Observatory.

Article 5. Determination of Telescope Time Allocation
Telescope time shall be allocated by the Director of the Nobeyama Radio Observatory.

Article 6. Usage Fees and Usage Time
1. The usage fees shall be as shown in the table below and the minimum usage time shall be four (4) hours.

Japan ¥10,000 per hour
Abroad ¥30,000 per hour
2. Users shall pay usage fees by a method specified by NAOJ.
3. The usage fee shall be non-refundable, no matter what the reason.
4. Notwithstanding paragraph 1 above, the telescope time requested by graduate students belonging to universities in Japan thatwhose programs have been scientifically assessed and selected by the ALMA Science Advisory Committee shall be awarded free of charge telescope time on the 45-m Radio Telescope for such approved programsmay use the 45-m Radio Telescope free of charge.

Article 7. Intellectual Property Rights
The intellectual property rights to any data obtained as a result of the use of the 45-m Radio Telescope shall be vested in NAOJ; provided, however, that the userobserver shall have exclusive access to the datapossession of the data for three (3) years after it is obtained by the userobserver.

Article 8. National Security and Export Control
Users from other countries (including Japanese users belonging to foreign companies or research institutes) and non-Japanese users who have stayed in Japan for less than six (6) months shall, at the request of the Nobeyama Radio Observatory, submit information necessary for national security and export control procedures.

Article 9. Users' Responsibility
1. Users shall comply with these Terms of Use and the usage rules set forth by the Nobeyama Radio Observatory with respect to the use of the 45-m Radio Telescope. Failure to comply may result in a cancellation of their use thereof.
2. Users shall take out necessary liability insurance or accident insurance on their own responsibility and at their own cost and expense.

Article 10. Disclaimer
1. As a general rule, NAOJ shall not provide users with any alternative telescope time even if they are unable to perform observations due to bad weather, natural disasters, instrumental failures, or any other unavoidable circumstances or if the quality of data obtained from observations is deteriorateddeteriorates.
2. NAOJ shall not be liable to compensate users for any loss or damage that may be suffered by them as a result of any termination, suspension, or cancellation of their use arising out of the circumstances set forth in the preceding paragraph.

Article 11. Other
In addition to what is provided for in these Terms of Use, any other matters necessary for the use of the 45-m Radio Telescope shall be determined by the Director of the Nobeyama Radio Observatory.

Supplementary Provision
These Terms of Use become effective on April 1st, 2022.

　　　　　　　　　　　　　　　　　　　　　　　　　　　　　　　　　　　　　　　　　　　　制 定

（趣旨）
第１　この要領は,国立天文台野辺山45ｍ電波望遠鏡（以下「45ｍ望遠鏡」という。）における観測時間の利用に関し定めるものである。

（利用目的）
第２　45ｍ望遠鏡の利用は,電波天文観測又は電波天文観測実習等,天文学に関する用途での目的に限るものとする。

（申込資格）
第３　申込は,国内外を問わず天文学の研究を目的とした研究者,学生等に限るものとする。

（申込方法・観測割当期間）
第４　申込方法,観測割当期間の詳細は,野辺山宇宙電波観測所において作成,周知する募集要項によるものとする。

（観測時間の割当の決定）
第５　観測時間の割当は,野辺山宇宙電波観測所長が行う。

（利用料・利用時間）
第６　利用料は,次の表とおりとし,利用時間は,最低４時間からとする。

２　利用料は,国立天文台が指定する方法により,納付しなければならない。
３　納付された利用料はその後の理由の如何にかかわらず返還しない。
４　第１項にかかわらず,ＡＬＭＡ科学諮問委員会で科学審査し採択された日本国内の大学に所属する大学院生については,無料で利用することができるものとする。

（知的財産権）
第７　45ｍ望遠鏡の利用により取得されたデータの知的財産権は国立天文台に帰属する。ただし,データの取得後３年間は観測者のデータ占有期間とする。

（安全保障輸出管理）
第８　国外からの利用者（外国の企業や研究機関等に所属する日本人利用者を含む）及び国内在住が６か月未満の外国人利用者等については,野辺山宇宙電波観測所の求めに応じ安全保障輸出管理の手続きに必要な情報の提出を行うこととする。

（利用者の責務）
第９　利用者は45ｍ望遠鏡の利用に関し,本要領及び野辺山宇宙電波観測所が定める利用のルールを順守するものとする。これに違反した場合には,利用の取り消しをする場合がある。
２　利用者の責任と負担において,必要な損害賠償保険又は傷害保険等に加入するものとする。

（免責事項）
第10　天候不良,自然災害又は装置トラブル等,やむを得ない事情により観測できなかった場合,又は観測により取得したデータの質の低下が生じた場合であっても,原則として代替となる観測時間の補償は行わない。
２　前項に定める事情等による利用の中止,停止又は解除により利用者が損害を受けた場合も,国立天文台はその損害を賠償する責を負わないものとする。

（その他）
第11　この要領に定めるもののほか,45ｍ望遠鏡の利用に関し必要な事項は,野辺山宇宙電波観測所長が決定する。

附　則
この要領は，令和４年４月１日から施行する。
