The following are the terms and conditions applicable to the use of the 45-m Radio Telescope and must be read in conjunction with the Terms of Use for the 45-m Radio Telescope at the National Astronomical Observatory of Japan (NAOJ) Nobeyama (hereafter “Terms of Use”) found at

Indemnification
The user agrees to indemnify and hold harmless NAOJ and its affiliates, the respective directors, officer, and employees, to the maximum extent permitted under the laws of Japan, from and against all claims, demands, damages, losses, liabilities and expenses including, without limitation, reasonable attorneys' fees and expenses which NAOJ may suffer or incur as a result of (i) any failure by user to perform or fulfill any of its obligations set forth in the Terms of Use, (ii) the negligence or intentional misconduct of user, or (iii) user's failure to comply with all applicable laws, rules and regulations.
Disclaimer of Warranty
NAOJ makes no warranties with respect to any equipment, infrastructure, services, technology or documentation which is provided under the program set forth in the Terms of Use, including, but not limited to, any warranty of merchantability, non-infringement, or fitness for any particular purpose. The user agrees that all such equipment, infrastructure, services, technology or documentation under this program are provided on an “as is” basis with all faults. The entire risk as to the quality of the equipment, infrastructure, services, technology or documentation under this program are with the user.
Limitation of Liability
NAOJ shall not be liable for any special, indirect, incidental, or consequential damages of any kind arising out of or in any way related to this program, whether such liability is asserted based on contract, tort, or otherwise, even if NAOJ has been advised of the possibility of such loss or damages.
Force Majeure
NAOJ shall not be held liable or responsible to the user for failure or delay in providing the services and facilities pursuant to this program to the extent that such failure or delay is caused by or results from causes beyond the reasonable control of NAOJ including but not limited to fire, flood, earthquake, or other natural forces, shortage of supply, labor disputes, strikes, civil commotion, acts of terrorism, wars, unforeseen public health events such as epidemic, plagues, disease, or emergency outbreaks, acts of God, or acts, omissions or delays in acting by any governmental authority or the user.
Acknowledgement
The user acknowledges that it has had adequate opportunity to review the Terms of Use and agrees to be bound by all the terms and provisions thereof.
